Roberts and Barrett join liberals as Supreme Court revives federal ghost gun restrictions

The Supreme Court on Tuesday agreed to freeze a lower court order that bars the government from regulating so-called ghost guns – untraceable homemade weapons – as firearms under federal law.

The brief order grants the Biden administration’s request to allow the regulations to remain in effect while legal challenges play out.

Ghost guns are kits that a user can buy online to assemble a fully functional firearm. They have no serial numbers, do not require background checks and provide no transfer records for easy traceability. Critics say they are attractive to people who are legally prohibited from buying firearms.

The vote was 5-4. Chief Justice John Roberts and fellow conservative Justice Amy Coney Barrett joined with the court’s three liberals to allow the rule to take effect.

Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh would have denied the application.

Neither one are conservative. ACB was championed on this board because she's Catholic, moderately attractive for her age and I think she has ties to Louisiana. She was never a good choice.

I don't disagree but given the time window available I don't think anyone else could have gotten through.

My understanding is this just allowed BATFE to do whatever they want until it plays out in court. Apparently Roberts and Barrett are OK with peoples rights being trampled while the BATFE tests the legal waters of their latest infringement…

Allows enforcement while case is litigated. Not a decision on the merits

Trump should have picked the best Constutionalist available.

He caved to the idea that RGB had to be replaced by a woman, so we got an Affirmative Action nomination.

If you expected a Court interventionalist in ACB, you were set up for disappointment.

We'll see where she falls when this case eventually arrives in regular order to SCOTUS.

This is the right way to do it. It sucks, because I'd love for them to just stomp the frick out of all of these batshit regulations, but that's not how we win.
