They are of course not going to decide Trump was operating in an official capacity.

They may not. They may send that back down to the trial court to decide, which may create a new avenue for appeal back to the USSC.

This depends on how much this exact issue was litigated at the trial court, unless they just go bonkers and violate their maxims and precedent.

Of course it is.

Not really.

If you want to argue it's his responsibility to investigate claims of fraud in state elections, then the proper avenue is to have the DOJ investigate (which he did, and he's not being attacked over).

Would you like to offer and explanation or should we just take your word for it?

The issue is that what Trump is accused of doing is almost certainly not an official act

They will try and make that case next. They will fail because it was obviously an official act.

You clearly ignore our current head of state at all hours of the day

You think Biden is going to get on a call with the Governor and secretary of State of Ohio or Florida and ask to "find" him some votes? You think Biden is going to have a Jan 6th moment? .

They can also be prosecuted. There's nothing that implies that impeachment is the only solution and the Constitution makes it pretty clear that criminal prosecution and impeachment are separate

In fact, Trump's own lawyer in his impeachment defense argued that he shouldn't be impeached after having left office because prosecution was viable.

Everything he does while he is POTUS is an official act.

I am enjoying that you’ve already retreated to the position that official acts of the president are immune.

I take solace in the fact that those prosecuting Trump will one day have to answer for their sins. Trumps conscious is clear; you can’t say the same for these demon-worshipping pieces of shite.

Naw.

Official act is using the executive legally, which Trump did. He had his DOJ investigate. Notice he's not being prosecuted for that or even accused of anything for that.

The lefties are acting like people are saying POTUS can legit walk up and murder someone. Which is the way theyll take advantage of in the future.

He was POTUS and federal elections integrity should fall under his purview. Also, as a candidate he should have the right to make sure things were done right. This isn't just a personal deal but a professional deal.
