I've been thinking the Republicans don't have the 50 votes to implement the "nuclear" option. Here is what I believe is happening or could happen.

Schumer can block cloture if he wants to. He knows the institutionalist on the GOP side want to avoid radically changing the Senate to a 50/51 vote governing body. The Senate was never intended to be a simple majority institution.

Schumer offers McConnell passage of Gorsuch in exchange for Ginsburg or Breyer being replaced by Garland. This keeps the balance of the court and the Senate. I think maybe deep down McConnell thinks this is the right move but he and Schumer must play the game out first to get this horse trade.

The republicans have been playing the long game in politics. Karl Rove mastered the art around 2006 to 2008. Control the states and turn purple red and blue purple. Keeping the state houses by re districting after 2010 census was genius.

Trump put a wrench in this and Scalia dying as well. No way republicans cave on any SCOTUS.

That deal wouldn't work. McConnell can't just say Garland will get Breyer or Ginsburg's seat. Trump would have to nominate Garland.

Will say, Senate Dems fricked the Senate forever by requiring it to be a simple majority for cabinet confirmations instead of requiring 60. That hurt them for the DeVos vote.

Of course Trump would nominate Garland in this scenario. I believe the Senate is looking over the abyss and is starting to reconsider the path its on. Harry Reid is a huge reason the Senate is where it is.

Rep are more likely to gain a few senate seats in 2018. No way they make deal with a stronger position ahead of them.

Sounds like a plan tha the GOP would be dumb enough to do. I don't know how many times they have to get their hands chopped off before they stop playing with the ax.

The GOP are the political versions of Cecil Collins Ryan Perrileaux. In the end all we will have is what could have beens because of idiotic and boneheaded decisions.

I agree, but would not be devastated if it did. A Garland for Ginsberg would be an improvement. Not perfect, but in the right direction.

This is the solitary fact that makes the shite sandwich we are all having to eat. We are going to have to ride out a non-perfect ideology-driven episode until the DEMs either come to their senses or die out.

There is nothing dumber than the GOP when they are in power. They do not inspire me that they will ever do the right thing.

Their only saving grace is that they are not inherently evil as the DEMs have become.

It was never intended to be directly elected either.

Any GOP senator that votes against the rule change should be shot. And I am not kidding.

GOP can go nuclear on this if they want to. The courts have too much power and this is too important to allow more dem rubber stamps on the SC

Wrestling cage match or boxing?
Chuck is 67 and Mitch is 75. But Mitch is bigger and has an Asian wife so he's probably pretty limber.

Ginsberg will have to be replaced with some sort of purple unicorn for the left to be happy. In the end, it's not Trump's job to make fringe lefties happy.
