No action on Travel Ban this morning. Could be this afternoon or tomorrow.

The justices added two new cases to their docket for next fall -- which means they will hear oral arguments and decide on the merits. The big addition today is Masterpiece Cakeshop v. Colorado Civil Rights Commission. This is a challenge by a Colorado man who owns a bakery and regards himself as a "cake artist." He objects to having to create cakes for same-sex wedding ceremonies, on the ground that it would violate his religious beliefs.

This will be the first "Bake a cake for a gay wedding" case to go before the Supreme Court.

The justices did NOT act on the travel ban this morning. We don't know whether there will be anything later on. There is another conference today, so they could act on it tomorrow. And it is possible that the justices could act on the stay -- that is, the government's request to reinstate the ban -- later on today. But it is not likely that the justices will act on the government's petition to review the lower court's rulings putting the travel ban on hold.

Do we know if Justice Kennedy hired clerks for next year?

Amy Howe
He has indeed. And one for the following term.

in favor of the church. This is a good win for common sense.

Church was denied the opportunity to apply for a state grant for its daycare playground. Interestingly, the state of Missouri has reversed it since.

The fact that four justices were against this is scary to me. This was about a damn playground.

It's fricking insane that the highest court in this country is hearing a case over whether a state can compel a man to create a cake when he doesn't want to.

They added a footnote though, that the ruling only applies to playground resurfacing.

Thats fine. No one in their right mind wants a state to fund a church. But this was a grant program for playgrounds. The church operated a licensed daycare in good standing. The only reason they were denied the grant is because they were attached to a church.

To confirm, there won't be any ruling on travel ban in this session?

The cases weren't included in this morning's orders, so no. The justices might rule on it separately later today or they might include it in an orders list tomorrow mornin
