I was pretty young when it happened, but but in the summer of 2005 Sandra Day O’Connor announced her retirement, then Chief Justice Rehnquist died a few months later. The Chief Justice position was filled first, and O’Connor agreed to remain in her position until Alito was confirmed in January of 2006.

I’m not sure if two confirmation hearings have happened in a closer timespan other than that though. Something new to put on my list of things to research!

They'd trot out this and say it's "dead discrimination" to say her seat is vacant.

I'd love to see what would happen. I hope she repents of her sins and trusts in Jesus before she goes, though. I wouldn't wish Hell on anyone. Even her.

If she died, we wouldn't know until she doesn't show up for the first meeting in the first week of October.

Ruth Bader Ginsburg is alive 'n kicking. She's not going nowhere, soon.

You could write one hell of a black comedy movie with that premise, you know if Hollywood were actually... creative and willing to skewer any and all comers.

True story - Rehnquist and O'Connor briefly dated at Stanford Law school where they graduated 1st and 3rd, respectively, in the same class.
