However I can't quite square that with recognizing the some individuals are beyond rehabilitation and deserve to be removed from society permanently.

Anyone else struggle with this?

a jury of your peers are the ones who actually do it. If im not mistaken, you need 11/12 or 12/12 for a death penalty conviction in DP states.

I struggle with the idea that those in power would get to say so.
They don't exactly have a flawless record in this area.

Not really. The government can't even kill people efficiently, so the one upside to this whole deal is non existent. More importantly, killing these turds doesn't compensate the victims at all. It's just the state getting more tax money.

Not at all.

But, I do believe that we should have a different standard for the death penalty.

For guilt, it should be "beyond a reasonable doubt."

For execution, it should be "beyond ANY doubt."

The very core of my anti death penalty position.

You wouldn't hesitate to put down a rabid dog, not for revenge but because its a danger to society. Some people just need to die, and we have a system in place that requires a conviction by a jury, best that can be done. Life imprisonment is crueler than a quick death in my opinion. Those are the only two options for the kind of people on death row

Isn't that what a life sentence in prison means?

The punishments in criminal justice system should be about rehabilitation (when possible) and public safety (keeping killers off the streets).

The death penalty is vengeance

I believe executions should be in the manner of the murder. The guy given lethal injection in Ark last night murdered a lady by striking her with a tire iron 39 times.
He should have been executed the same way.

Like was said above, those in power don't get to say so. They just execute.

A jury of your peers makes the decision, or at least the recommendation to the judge.

If I remember correctly, at least in Alabama, the jury first has to find you guilty of capital murder, then has to agree to recommend the death penalty.

No, it should be about victim compensation. Everything else is the state jerking itself off.

This is incredibly naive.

The jury sees what the judge and DA want them to see.

How many times have DA 's withheld exculpatory evidence to ensure a conviction even though they knew the defendant wasn't guilty? Even for a DP case? That's just state sanctioned murder at that point.

I don't struggle with this at all. No level of gov't should be allowed to execute its citizenry. The gov't at all levels is totally inept. Why would you allow them to make permanent life and death decisions?
