For the purposes of this subsection, the term "official action" includes deliberations by the governing body of a governmental entity.

It does. Rick Perry should direct the attorney general to make sure she is prosecuted for it. Its certainly possible a jury could be convinced the threats made by someone in a drunken rage and never followed up on at all were intentional. Go for it. In the mean time it looks like the guy who made the threat 100% sober and who followed up on the threat 100% will be prosecuted first.
(Though if you ask me state governors and the President should be immune from criminal prosecution while in office, so long as they waive the statue of limitations during their term. Impeachment and removal when crimes by a governor or President must be addressed before his term is up)

The yanked funding directly impacted an investigation into millions in fishy grants of one of Perry's pet projects the Cancer Prevention and Research Institute of Texas. The DWI was an incredibly fortunate coincidence for Perry, as he was able to effectively squash investigation into his corruption (so he thought).
