The DOJ cannot just walk in and tell the IRS what case to drop and what to take up. The DOJ doesn’t have any authority over Title 26. That’s all IRS.

If this is what happened.. one of two things is possible. Neither is more palatable than the other.

1) The DOJ asked nicely and the IRS was looking for a way out and just rolled over.

2) the DOJ said they wouldn’t prosecute any crimes they found so they are wasting their time.

#2 wouldn’t stop the IRS from assessing tax on unreported income and collecting it. But the criminal aspect is toast.

If it’s #1, the country is toast. It’s officially a two tiered justice system AND tax enforcement system.
