The Justice Department on Saturday evening filed a notice that it will formally appeal a federal judge's ruling halting President Trump's immigration order. Justice Department Attorney Michelle Bennett's filing was made in response to a temporary nationwide restraining order issued Friday that halted Trump's executive order banning citizens of seven countries from entering the United States. The case now goes to the U.S. Court of Appeals for the Ninth Circuit.

This is likely going to end up before the Supreme Court eventually, as Trump is not one to back down, so what the 9th circuit says shouldn't concern anyone, I think.

Well, since the vote by SCOTUS could easily be 4-4, isn't pretty important which side is actually the one to be filing the appeal to SCOTUS? Wouldn't it take 5 votes to overturn the vote of the court below it? That would make the lower court decision pretty important.

By the time all of this crap is settled, the ban will be over based on the original timeline.

Thats what im saying. The EO will end before any of these cases are settled. The time frame was what a 3 month window and yet people have lost their collective shite thinking it's permanent

You'd be shocked at how quickly they can move it along if they want to. Bush v. Gore made its way up there in a hurry (I know that's different, just saying it can move quickly).

Actually, I would think the ban would just pick up where it left off on x amount of days and Trump may see fit to add to the length of the ban to further vet the people that came in during the TRO.

There is already precedent in this:

See Jimmy Carters ban on Iranian students in 1979. He kicked a bunch of Iranian students out of the nation.

Look up the Immigration and Naturalization law of 1952. This has been law for well over 65 years in this country.

This judge in Washington should immediately recuse himself from this case.

This judge is an 'advocate' for illegal aliens. There is a HUGE conflict of interest.

Do you have any proof of this conflict of interest?

How is doing advocate work a conflict of interest? Is he profiting from it somehow?

Don't you think that this judge (who is an advocate for illegals) does NOT have his judgement clouded by his work?

I say it does and he should immediately recuse himself.

IDK if he 'profits' from it or not. But the fact that he is an advocate for illegals shows that his judgement is NOT clear

Having a tendency towards one side of the other is not a conflict of interest.

If that was the case the judicial system would grind to a halt.
