President Donald Trump had a constitutional right to tell FBI Director James Comey not to prosecute former national security adviser Michael Flynn, constitutional expert Alan Dershowitz said Saturday.

In remarks on "CNN Newsroom With Ana Cabrera," the Harvard law professor said there are two remedies for those who are outraged over Trump's firing of Comey after the president reportedly pressed Comey to drop his investigation of Flynn – "amend the Constitution, [or] don't vote for him."

"But don't try to expand the existing criminal law in violation of civil liberties to do what Stalin did, where [secret police chief Lavrentiy] Beria said, 'Show me the man, I'll give you the crime,'" Dershowitz said. "That's not America."

"
quote:

There's not that much new that would warrant either an impeachment, certainly not a criminal prosecution."

Dershowitz, who confesses he voted for Hillary Clinton, said "I care deeply about not expanding criminal statutes to fit people we don't like."

Very Interesting

Pretty useless story since he didn't give the reasoning on why Trump had the authority to call Comey off Flynn, other than a vague reference the Constitution.

Because the FBI is part of the executive branch.

It's not a "crime" to ask Comey to back off of Flynn.

Focus on the word "crime"

Correct, the President has the power to nominated and remove a sitting FBI Director. Was it a crime to ask Comey to back off Flynn, no. Was it idiotic to say the reason you fired him was because of the handling of the Russia investigation, yes. But was it a crime, technically no.

Even if the President did say to Comey 'let it go, when it comes to Flynn'. Under the unitary theory of the Executive the President has the right to direct the Justice Dept. and the right to direct the FBI what to do.

So historically the President is the head of the Executive Branch and he can't be convicted of obstruction of justice for simply performing his constitutional duty.

What the frick does it matter?

Comey basically told Trump to eat shite and was going to pursue an investigation.

Flynn is going down on several counts related to not disclosing his financial ties to foreign governments, Manafort going down on similar charges.

Trump will be impeached for obstruction regarding Comey's firing, not his immoral pressure on Comey about Flynn

We have been living under an Ivy League social experiment for over 150 years. Time we get some SWAC or SEC blood in the Oval. #SouthernGents

Can you really say that when the investigation is ongoing and there is now a separate investigation being conducted by Mueller?

I don't disagree at all about Manafort and Flynn but getting all huffy with Dershowitz because you don't like his professional opinion without substance makes you look exactly like the people he refers to in this Friday article he wrote.

Have a nice slow read. One of you is a constitutional lawyer.

Comey also basically told the American people that although Hillary Clinton technically committed a crime he would let the people decide what was best for their country in the election. The guy has been known to talk a lot and hold people accountable a lot less.

The counter argument was that Comey was trying to use the Trump campaign investigation as leverage over Trump in order to remain as the head of the FBI. Trump might have privately gotten Comey to admit he wasn't specifically under investigation as Comey dangled there might be criminal intent after 8 months of zero proof.

I'm playing devils advocate because nobody really knows what's been said between the 2.

They're going to try to get Trump to lie under oath about not having financial ties to Russia which he surely does.

Once the FBI gets enough circumstantial evidence surrounding Trump to gain access to his tax returns its game over Man.
