The extraordinary resolution was approved by the Joint Commission on Public Ethics on Tuesday in a 12 to 1 vote — coming a month after the ethics agency voted to revoke its prior approval allowing Cuomo to earn outside income from his book, “American Crisis: Leadership Lessons from the COVID-19 Pandemic” while he was still governor and New York was still battling the deadly viral bug.
JCOPE rescinded its approval after concluding that Cuomo violated pledges not to use state resources or government staffers to prepare the book.
The resolution, drafted by commissioner David McNamara, a Senate Republican appointee, said Cuomo now “lacked the legal authority to engage in outside activity and receive compensation in regard to the book” since JCOPE rescinded its approval.

I can't stand him or Fredo, but, I don't think they have the legal authority to do that.

Maybe not within that independent panel in and of itself, but every state has a Department of Ethics with statutes and of course the Inspector General's office overseeing public corruption, malfeasance in office etc. Depends how far Andy wants to take this, but it's not uncommon for civil matters to turn into criminal matters rather quickly. And you couple this with the 2,000 plus page NY AG's report, yes it's probably in Andy's best interest to pay the book profits back sooner rather than later.

I would think if it can be proven Cuomo broke the restrictions of the agreement, then the agreement would be null and void and any profits received from the book using state funded resources would be subject to forfeiture, no?

Yup. Nor should they have any authority to do so.
This was a private contractual arrangement which had zero to do with the city.

These book deals to sitting politicians are nothing but bribes. Courts have held that almost any citizen has "standing" to sue the bribe receipent to recover the money on behalf of the state. Spiro Agnew was sued by law students to recover bribes he received as governor of Maryland, and the students won that case.

The only issue I see is how they gave the ok for him to profit off it in the first place. That's a big no no as a state employee.
