Definitely looks like a rattler of some sort.

ETA:

What part of the country are you in? BC it looks like a blacktail...

It's one of those completely safe rattlesnakes I bet. The ones that don't bite and aren't dangerous in any sort of way - he should have gotten closer to get a better picture.

ETA: The Pygmy does not have the rings around the tail. The Massasauga does not have the black before the rattles.

You should let it live unless you want mice.

I don't know about you, but I'd much rather step on a snake than a mouse. Snakes are just so much more pleasant animals.

That is my thought as well, but the pattern and color make me think massasauga which is why I'm wondering where the OP is located. I mean, it's the same genus and all.
