District Court applied strict scrutiny to infringements upon the Second Amendment.

So dealer lost business and sues for relief from the Federal Handgun Transfer Ban.

"Accordingly, the Court DECLARES that 18 U.S.C. § 922(a)(3), 18 U.S.C. § 922(b)(3), and27 C.F.R. § 478.99(a) are UNCONSTITUTIONAL, and Defendants are ENJOINED from enforcing these provisions. The Court will issue its final judgment separately."

Federal Judge Strikes Down Interstate Handgun Transfer Ban

In a ruling issued today, a Federal judge has declared that the longstanding ban on gun dealers selling handguns to residents in different states is not only unconstitutional under the Second Amendment, but also violates other fair trade provisions of the United States Constitution. Louis Bonham, one of TTAG’s consulting lawyers, wrote the following analysis of the ruling:


The suit was brought by a Texas gun dealer, two District of Columbia residents, and the Committee for the Right to Keep and Bear Arms. In what appears to have been a test case, the DC residents wished to purchase a handgun from the Texas dealer, but federal law prohibited them from doing so without having the Texas dealer ship the gun to DC’s only FFL, who would have charged them a $125 transfer fee.

They then filed suit in federal court in the Northern District of Texas, arguing that the federal prohibition on direct sales of handguns by FFL’s to out of state residents unconstitutionally violated their rights under the Second Amendment and the Due Process clause of the Fifth Amendment.

Ok so if I live in Bama can I buy handgun in Mississippi now?

No, this applies to this current district in Texas where the ruling was made. If it is appealed, it would go to the 5th circuit and if confirmed, you could buy in Mississippi.

That part I wonder about. There are exceptions for military on PCS orders that allow you to purchase handguns and "firearms" when you live away from HOR as long as you can prove residence in the state the orders PCS'd them to. TCS orders don't work that way though.

Sucks to live in DC $125 transfer fee.

I only pay $15 in louisiana so it doesn't matter to me if I buy a gun in BFE and get it shipped to my FFL.

Now if they would let us get guns transferred from Canada to here

If this passes through the courts and holds. You could buy a gun at any store in the US, and walk out with said gun the same day. You could then ship the gun to yourself at your home address or any other address you choose. You could also drive or fly the gun home...

Anyway, I like the potential outcome obviously... Being from Houston, during my time in school at LSU, I've passed up on two good deals here in LA, because I can't buy handguns here

ETA, hopefully applies to ARs and Lowers too

Will make it like it was before 1968, and it should I hope other suits quickly get filed in all other districts.

Wouldn't this make prices fall a bit? Local stores would have to get in line with out of state prices or lose the sale?

I would hope. And most importantly.. private sales across state lines would start happening. There are several deals I've had to pass on through FB groups where I've seen hella deals, but the seller wasn't willing to go through FFL to complete the deal and I wasn't willing to risk losing a right because of an unconstitutional law on the books.

You already had the ability to buy ARs from other states.


ETA, and any other rifle. And lowers, and shotguns
