Executor of a will

If an executor of a will is named...does that person absolutely have to execute those duties or can an immediate family member do it ?

I do not know the probate rules down there, but up here an executor may renounce in favor of another. It's a simple process unless others want to step into the role - even then it's not a complicated process.

I do not know your court system, but I would guess that the judiciary has a web site that would give you information and/or forms to renounce. Also, while the clerk's office probably will not give you advice, they will provide a booklet on the probate process or the appropriate form. Good luck.

ETA: If that fails, contact a lawyer in the circuit in which the will is to be probated.

Do it. I was recently asked about being put in a will as the executor. You get a percentage for filling that role.
