Ferguson civil suit

So, I'm listening to this legal analyst on TV this morning and they ask him if the Brown family will file a civil rights suit. He sad 'absolutely.'

Host: But what if there is no evidence?

Him: "Doesn't matter. There's too much money for the lawyers in play. Civil Rights laws require that the state pay attorney fees if the Browns cannot. If the jury votes Not Guilty then the lawyers cannot bill the state. But sometimes a jury will say "OK, guilty and we award the Brown family 2 dollars."

In that case the Browns get 2 dollars and their attorneys can bill the state for Hundreds of Thousands if not a Million in legal fees."

What kind of idiotic policy is that?

Lawyers get all kinds of benefits no other profession get. Lawyers also run DC.

An idiotic policy you would have for every case if you ad a "loser pays" law for all injury suits.

Doesn't really matter in this case because there would be money damages if brown wins.

But this kind of thing enables people bound to wheelchairs to get into retail stores if you think it through.

If the family does file a civil suit against the city, the city should file a civil suit against the step father for inciting the burning of businesses

But it could be a token amount. IE, the prosecutors know they have no case. So, they focus on presenting the family as devastated by the loss of their dear child.

The jury deliberates and says 'The cop is not guilty but I feel so bad for the family. Let's award them 20,000.'

Then the lawyers file for their fees with the state and you would be amazed at the number of hours they worked on the case.

Yes. It encourages frivolous lawsuits. It is not imagined. The analyst said it happens.
