You are standing in the United States. Across the border in Mexico is someone you want to kill. You shoot said person still standing in the United States, and the victim collapses in Mexico. What country would you be prosecuted in? Wife says us I say Mexico.

Honest answer, this happened in a recent (last 6 months) US Fifth Circuit case. The Border Patrol agent was not prosecuted, but he was sued here in the US civilly. So, the U.S. can exercise jurisdiction.

I had the same conversation with a colleague this week in regards to the four corners between NM, AZ, CO and UT.
If you have one foot in NM and one foot in CO, and you shoot someone who has one foot in AZ and one in UT, where are you prosecuted and what state issues a death certificate?
