A/C Repair Company Insisting on Disposing Broken Equipment for $150 - Legal?

Can a company insist on removing equipment from my home? I can dispose of it myself for less than $150.

If it has freon or residue in it yes, but they will probably just throw it in a dumpster.

Typically they include haul off as part of the installed price.

Don't let them kid you. They may have a scrapper that is licensed for disposal but that freon is getting vented to the atmosphere...and we will all be fine.

Unless it was part of the quoted price you agreed to I would balk.

It's a coil. Does that have freon? I asked her if she needed to dispose of it even if it did not have freon and she said yes.

I said I was going to report them to the BBB for it, but she didn't bite.

They will probably recatch the freon in the condenser and scrap the rest either at a recycling place or reuse what is still good making money off of it all. I wouldn't let them do it and no they can not make you.

Yea you could probably get $100 for it and the copper in it at a scrap yard. You get paid and get free disposal.

Oh I'm fricked because I'm going through AHS as a landlord, and this is two weeks overdue for my tenants. I'm going to end up paying it.

That's because the BBB is a joke and has no legal authority. They are just a private entity that operates like the mafia.

Tell her that you will call the attorney general on her for unfair business practices.

Her name is Maude. She probably thinks the attorney general is part of the liberal agenda.

If I can be there for the repair, I'll tell the guy after he's done that he can't take it.

Yep. Also you can file complaint against their state contractor's license (if they have one). No one likes that.

They will tell you that it's a civil matter and they can only enforce anything against a contractor after a civil case has been found in your favor.

I had someone try to file a complaint against mine when I was in the right and that is exactly what they told the woman.

They can not enforce any civil action. All they can do is enforce the contractors code in making sure you are properly licensed for the work you are doing and hold hearings to revoke licenses after civil cases are tried.

I know they're not a court and really cant do much but most contractors don't want anyone contacting the state. (especially companies that are shady or don't have a state license when they're supposed to).

I think the a/c guys end up throwing this in when they do those home warranty repairs because they aren't making much on these. A few months back they tried charging us $300 for the removal. Told them to get fricked and didn't pay it.

Wait until they are done with the work and then just refuse to pay for the removal. Tell them they can leave the equipment there and you will get rid of it or they can take it with them. What can they do?

Yea but you don't have to have a state license to do residential A/C work that I can recall. Especially if you are doing work under the $15K mark. Just need the license to buy and handle freon. Napoloen can tell you for sure. He has one.

ETA: I would also complain to AHS. They probably don't want to lose their work load AHS provides.

Going to do this also. Right as I'm calling to cancel with AHS.

No reason why a service request expedited for a medical emergency should take two weeks to complete. And then in the end NOT frickING COVER MOST OF THE CHARGES.

Tell them you'll dispose of it yourself and sign whatever release they want saying you'll do it responsibly.
