He's stating that if the sermon isn't relevant then it should be quashed. What he actually submits is that the subpoena does not raise a first amendment issue but that may be overbroad in some respects. If the sermon did contain specifics as to the signatures petitions he believes it would be discoverable. Do sermons aren't off limits should the contain relevant information. That would be determined at the motion hearing.

Clearly you've missed the point many have tried to make and volokh has made that it all comes down to relevance. You and genro have dismissed it out of hand and argued it violates the first - volokh's commentary in no way supports that position. But keep digging, you may have been to China and are on your way back now. GLTY.

Because government is not a higher authority than other social institutions that benefit society. It is established by the governed for the purpose of providing a safe and secure environment for society to grow and thrive. Hence a church is not subordinated to the government but serves a function for the betterment of society.
