He's stating that if the sermon isn't relevant then it should be quashed. What he actually submits is that the subpoena does not raise a first amendment issue but that may be overbroad in some respects. If the sermon did contain specifics as to the signatures petitions he believes it would be discoverable. Do sermons aren't off limits should the contain relevant information. That would be determined at the motion hearing.

Clearly you've missed the point many have tried to make and volokh has made that it all comes down to relevance. You and genro have dismissed it out of hand and argued it violates the first - volokh's commentary in no way supports that position. Would have never though Houston was better off with Lee P. Brown as mayor... no small feat. Bring the airport signs back!

Not just for those who do not like others views as this mayor portends these 'sermons' should be scrutinized and more to the point forbidden.

Because government is not a higher authority than other social institutions that benefit society. It is established by the governed for the purpose of providing a safe and secure environment for society to grow and thrive. Hence a church is not subordinated to the government but serves a function for the betterment of society.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, — That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.
