Well...looks like Kennedy wasn't the reason the SC punted on gay marriage review

That's standard practice these days with the court. Almost everything (important) gets blocked until the other side can respond and the matter is referred to the full court.
Obviously, that doesn't apply to the thousand frivolous requests for a stay the court gets a month.
Hell, even Kagan blocked the 7th Circuit ruling until the whole court considered it.

Maybe the Court will take this as a do-over and just go ahead and rule on this shite.
