Allen, a 27-year-old Philadelphia mother who says she mistakenly entered New Jersey with a handgun legally registered in her state, was not accepted into a pre-trial intervention program, unlike the former Baltimore Ravens running back who was caught on an elevator surveillance camera punching his then-fiancée and current wife. The disparate decisions, made by the same prosecutor and approved by the same judge, leave Allen facing more than three years in prison and Rice free, though disgraced.

What weight does the woman not wanting to press charges carry?

On poors.

Pre-trial intervention is a system specifically designed to allow the wealthy and influential to buy themselves out of criminal convictions.

Basically, the rich folks got a bunch of draconian drug laws passed - then they realized their kids were getting arrested for drugs, so instead of changing the sentencing laws or decriminalizing drugs, they create 'pre-trial' diversion, so they can make sure their kids don't have to suffer the same fate as the poors when they get arrested for drugs. And it gets applied to other things apparently like domestic violence? Really? That's fricked that you could get off of a violent crime with pre-trial, I thought it was only for non-violent drug offenses.

I can tell you this - if I were on a jury (and I will potentially be, next Monday), and a prosecutor showed me the tape - I'd vote guilty no matter what the victim said. Wouldn't you?

She could say "I begged him to hit me" and I still wouldn't believe her. Guilty.

The Violence Against Women Reauthorization Act of 2013, or VAWA, has been passed by the U.S. House of Representatives and the U.S. Senate, sending the bill to the White House for President Barack Obama to sign.

The House passed the bill Thursday by a vote of 286-138. Every House Democrat voted in favor of the bill, while all of the 138 votes against it were cast by Republicans, though 87 GOP Representatives did vote "yea." The Senate passed the bill on Feb. 12 by a vote of 78-22, with all 22 "nay" votes coming from Republican senators.

In this case it should be very little. The state can press charges regardless of what some intimidated victim decides.

If you were on a jury you would never see the elevator video. Ever. Impress me and guess why

Have you read that bill? Will you go on record right now as being 100 percent for it?

a misdemeanor charge and a felony charge with a mandatory minimum are not comparable. most laws (esp on the coasts) are written to create aggravating factors if guns are involved, which likely eliminates a shot at a PTD program

Probably, but that isn't the topic if the thread. It is referring to the prosecutor's actions.
