Chief Judge Kozinski (9th Circuit): Bring back the firing squad

Kozinski wrote a blistering dissent in a 9th Circuit case condemning the use of lethal injection as a process flawed from the get go and urging states to bring back the firing squad.

Thought some of you might like to read the dissent, and for those who don't, here's an article discussing it.

ETA: I know it's probably as sarcastic as it gets, but it's still a pretty valid point.

There is the odd chance that a misfired bullet would kill an innocent bystander. No need for more useless appeals.

Personally I would go with hanging. Rope is quite cheap; steel cable is reusable. (Plus, you can have "Renegade" playing in the background as the condemned takes his/her last steps.)

I don't object to the firing squad coming back, at least from a practicality standpoint.

10 men with 30.06 rifles aiming at an inmate, with a few of them given blanks, would be fairly effective in executing an inmate with a minimum of suffering in comparison to the gas chamber.


It's not my preferred method of execution, if only because it gives ammo to the anti-DP activists, but it's not cruel if it is near-instantaneous death and it's certainly not unusual given the number of gunshot victims in the US.



The judge was right about California and their inability, or unwillingness, to set protocol for executions.

They have a defacto stay which won't be lifted until there is a major political change in the state, which likely won't happen anytime soon.

The argument of "cruel" for hanging deals with how the noose is put on the condemned as well as their weight.


If you've got a big fat frick on a gallows, there's a good chance their head could pop off completely.

I think we should just use the cattle rod gun that they use in slaughter houses. A steel rod in a gun connected to compressed air.

Put it to the head and pull the trigger... Instant, clean painless death.

Just a matter of using the appropriate length of rope. Would be more effective and humane than shooting imo, there are cases of humans being loaded full of bullets and continuing to live.

Besides, having your head pop off would probably be preferable to strangling to death.

Drowning wouldn't be a bad option either imo.

That's why I'd use steel cable. More than likely it supports the heavier weight. (And if it didn't it would cut through quicker, again a successful execution.)

Besides, how come the anti-dp crowd cares so much about the condemned, yet nothing about how the victim died (which, in some cases, was absolutely horrific?)

If the death penalty is to be used, I like the suggestion of the cattle thingamabob. Anton Chigurh liked it, too.

Yeah strap his head down and pull the trigger. It would never wear out. That would save millions of dollars in equipment and lawyer fees, no electric generators to the polute the environment, leaving Obama money for more vacations.

Nitrogen asphyxiation or hypoxia.

Two very painless forms of execution, you just breathe and then drift off to sleep and never wake up. It's unbelievable they aren't used for the DP. It'd prevent a mess like what we have making the rounds through the courts now these days.
