Yes..The guy was only complying with what he was told to do by an officer of the law..He left his house as he was directed too. Who is to say that he didn't tell the officer on the phone he was drunk and was told to come anyway..

Maybe not should, but might. What if his argument is that he didn't have anything to drink until after he got home, because he was so shaken by the h&r, told this to the SP, and they directed him to come in regardless?
