Does anyone know how logo licensing works for high schools?

Thread on the RB board with the top Louisiana recruits and I see this pic:

So that's the Kansas State wildcat logo. Do high schools have to pay out to the colleges or other teams to use their logos, because I see it all the time with local schools. Or do they give them free reign? How much would that be if they did have to pay?

I would guess free reign because honestly some of the schools i've seen that use colleges logos have barely enough money to buy the whole team jerseys, much less pay the colleges to use their logos.

What I would think would be that maybe the big 5A 6A schools that get big time national exposure would pay the colleges. But then again I heard U-High had to change their helmet logo because of University of Miami. They had the classic U logo in yellow and white.

Plus since there are so many high school teams colleges may not have the energy or time to go through all the trouble of collecting liscensing fees from everyone

The high schools use them without consent and the colleges(in the past) have just chosen not to do anything.

That is changing for some schools though. You have to actively defend your trademarks or people can argue that you have abandoned it. If schools want they can simply write a letter and allow the school use.

The problem is if they don't then theoretically a local shop could start selling stuff with the logo and argue that they haven't defended their trademark in the past.

Wisconsin made the woodlands highschool here in Houston stop using their W.

I don't think the NFL has started doing any of this though.

Yeah, perhaps it's just up to the individual university. We have a school in our own state that uses our Gamecock logo.

Born and raised a Gamecock fan and I've never heard the university ever have an issue with it.

That might explain it. There are a couple of small, local, and crappy looking bars that use that logo and have some "Gamecock" themed name to the bar. I always figured the university didn't know about it or just didn't care.

We had the same thing at central during my time there and we asked a coach one time

Most colleges dont give a flyin frick because its basically free advertising BUT they have to recieve some sort of compensation in order to keep the patent valid.

The coach told me that they pay like 1 dollar a year to use the logo.

St Amant did get sued by Florida for using the Gator and the Swamp monikers

This is the same reason you see giant companies that go after little guys who may use their likeness. They have to do it for legal reasons.

I doubt most colleges do anything. Its hard as hell to come up with an original logo without shelling out a shitton of cash. Patterson had a "new" one a few years back thats a remake of northern Arizona's.

The logos are licensed and the property of the parent team. MLB made it easy for little league organizations to use their logos by creating a cheaper brand licensed product.I would not expect a college to allow use of their logo no matter what.

Trying to remember what the Patterson logo was when I was there ('90-'93). I guess it was just that lumberjack with the axe over his shoulder. I know the football helmets were just black.

Do they still do that "Lumberjack Chop" akin to the Braves and Seminoles? I hated when that started.

Yeah, it's pretty blatant with little league teams. That would make sense.

My junior or senior year at STM we got sued by Penn St for using their logo. Don't know what was settled in the suit

We had one of the LSU Licensing and Merchandising guys speak to our BLaw class at LSU. I remember him talking about NCAA logos being free for use by high schools sports teams. It increases the university's exposure, or something along those lines

I think Florida has gone after several schools in the south east that have tried to use the Gator logo.

FSU went after a high school in the Atlanta metro a couple of years back because they used the name Seminoles and had the spear on their helmet. They allowed them to keep using the name Seminoles (provided it was always preceded by the high school name) but they had to completely overhaul the logo on the helmets and at various other places throughout the school.

My high school used to have an NFL team's logo. Now they have an original logo.

Don't know if they were told to stop using the NFL team's logo or if they just decided to change on their own...

What about Green Bay, UGA, and Grambling all having the same "G".
