The Canadian Supreme Court has upheld the sexual assault conviction of a man who poked holes in the condoms he wore during sex with his girlfriend.

quote:

"A person consents to how she will be touched, and she is entitled to decide what sexual activity she agrees to engage in for whatever reason she wishes," the high court wrote in its decision on Friday.

"Because of the deliberate deceit of her partner, the sexual activity was not carried out in the manner that the complainant had agreed to."

Would this hold up here in the US. Does this mean that a woman can be convicted of sexual assault for lying about taking birth control?

No. Just like in false rape cases, marriage and child custody, its all set up for the man to fail.

I think it should, if you could prove her not taking it was on purpose (her lying is clearly on purpose) as well as establish that there was an understanding that she was on birth control at the time of sex.

I agree, and also agree that it would be hard to prove.
