On Thursday, the U.S. Ninth Circuit Court of Appeals upheld a California high school’s decision to outlaw American flag t-shirts on Cinco de Mayo. Officials at Live Oak High School banned American flags on May 5, 2010 because the year before there had been altercations between white students and Mexican students. There were American flags and chants of “USA.” According to reports, there were also Mexican flags and kids running around saying, “frick them white boys. Let’s frick them up.”

On Cinco de Mayo in 2010, a handful of students showed up with shirts emblazoned with American flags. The principal told those students to turn the shirts inside out or leave school. All kinds of threats against those flag-wearing students occurred around May 5, 2010 as well.

School administrators at Live Oak High School – a school with a predominant Mexican-American student-body – had called the patriotic apparel “incendiary.” (RELATED: Students threatened with suspension for wearing U.S. colors on Cinco de Mayo) Students of Mexican heritage told local media that the American flag-festooned students should apologize. They said ethnically Mexican students wouldn’t wear a Mexican flag on the Fourth of July (not a school day, but never mind). The Ninth Circuit held that school officials have wide latitude to limit freedom of expression.
I really don't recognize our country anymore.

Were the Mexicans allowed to wear Mexican flag shirts?
That means freedom of speech, right?

That's what," transforming America" means.

I read the opinion the other day. Rightly or wrongly, the opinion goes to great pains to show just how bad the tension was in this school, and before the request was made by the principal, another white student told the principal that an all-out brawl was about to break out.
The opinion seemed to be much more about an administrator's ability to keep peace, order, and protecting the students than about free speech.

No way the Supreme Court takes this case because the facts are bad.

I have to say I generally agree with limitations put on the free speech of minors. However in this case, they're being applied asymmetrically. Either everyone should be allowed to wear the flag of their choice, or no one.
Also, I find it vulgar to wear the flag. It's a flag, not a logo. It's meant to be hung and allowed to fly. I don't even like it being used as a patch on a uniform. Wave the flag, don't wear it.

Then why not ban Mexican flags as well?

Oh, I agree. They all should have been banned. But, I can't fault an administrator for taking quick action to prevent the larger harm. I don't count that as an overt violation of free speech.

Ah. So, as current immigration is showing us, might makes right (in the name of safety and preventing the larger harm of course). Interesting message this sends IMO.

We should mandate that they fly the ol sickle and hammer. We must unite our students for the common good and keep moving forward.

What if you wear a rainbow flag shirt on Flag day?
What if you wear a shirt with both Mexican/American flags?

On the one hand this is a freedom of expression case on the other you have school administrators trying to mitigate violence in their school....an ugly situation.

Yea, it's definitely not a good situation at all. If the administrator had elected to do nothing (hooray, everyone has free speech!), then the school board would be facing a hefty, hefty lawsuit if anyone is injured.
It's an interesting opinion, and like I said earlier, one that seems much more about protecting students than one about free speech.
