Ill-fated Carnival Triumph passengers seeking up to $1M in damages

Like many of the witnesses, she testified that she lived for days in total fear that they might not finish the voyage alive. "I was fearful, downright afraid and scared," said Fleda Key.

So basically only a few who got seriously injured are had issues are seeking 1 mil. Misleading title.

$30k doesn't seem to harsh.

I'm sure they're exaggerating a bit, but I think they deserve to get paid. I wouldn't want to live like that on my suppose vacation for a week or so.

Everybody on that ship should get something, but unless someone died of has life changing injuries, no one should get $1M.

Fortunately, stupidity does not constitute actionable damages.

For better or worse, these folks will get something out of this, though. However, nobody will get $1 million, or anything close to that.

I seem to recall on other ones where this has happened, the passenger contract has some statement about "if something like this happens, Carnival is not responsible" or something like that.

Usually what happens is they refund the cruise/air/hotel fees and give them a bit of money, but not a lot. Nor should they really.

Those kind of forms usually are useless in negligence situations. At least in some places.

agreed. Carnival should offer fair compensation for what they went through with little hoops to jump through. Then they should fight anyone who wants more than they deserve.

I expect the passengers that Carnival attracts to go for a payday, but how does Carnival not have a plan from a risk perspective? You would think they would be able to get people off a stranded ship within a day

Yea, these liability waivers don't do much in situations like this.

from a risk management perspective, those forms would have had more use as toilet paper on the ship. No reason not to have the passengers sign it, but it isn't really protecting Carnival at all if they were negligent and at fault.

It was cheaper for Carnival to tow the ship and passengers back than any other option. Take the loss on the lawsuits and be done with it.

I don't agree with that. They PR hit + the lawsuits are going to do more damage than the $$ would have done
