Question for the O-T Armchair Lawyers Guild

So one of my drivers backed into a 04 pick up truck
in a parking lot that the driver left angle parked behind him. My driver reluctantly agrees to pay for the damages with cash. We bring it to 2 body shops.
Our body shop comes up with a $3800 estimate while his comes up with a $5400 estimate. Now he wants it fixed at his body shop. What does the law say?

Well I believe it is up to him unless you get insurance involved. The guy is supposed to mitigate repairing prices though if of equal quality. But then again I'm no lawyer.

It's my understanding that the Victim has choice of the shop pretty much every time.
*not a lawyer, just worked in a body shop in high school and this was always the case. Lots of insurance fraud going Down. Police owned shop at that.

Law doesn't address hush-hush cash exchanges, to be determined and agreed upon by the parties involved.

Sounds like you are either paying what the guy wants or going through insurance

Right. Probably come out cheaper paying the extra couple grand than having insurance involved, the possibility of paying that anyway (or more) and your rated going up.

Offer the guy $4000 cash or you will turn it over to insurance. Tell him your insurance will probably total a 10 year old truck with $5400 in damage and sell it for salvage upon settlement.

Call his body shop and tell them you'll give them 4400 bucks to do it.
