Also, a suit was filed challenging Louisiana's ban, mostly due to the state law requiring federal and state tax returns to mirror each other. A gay married couple must either lie to the federal government on their tax returns or violate state law.

Saw this coming after the Supreme Court rulings. Federal recognition coupled with some state recognition creates a huge disparity in those states that wont recognize the other states marriages.

Then, someone from a state banning gay marriage will file suit and then U.S. Supreme Court, based on their previous precedent, will force the state to recognize and affirm all gay marriage in all 50 states. Actually, those suits have already been filed. It is just a matter of time. 2-3 years at the most.

14th amendment is abused like no other these days.

It's ridiculous. Judges twist it to make it mean whatever they want.

Sad

They might as well just go to the Archives and take the Constitution out of there.

I don't care about gay marriage, but with the shear volume of Federal selective enforcement of state laws as of late, we've completely lost sight of the point of the document.

Fed judge telling a state that the 10th doesn't mean shite anymore, actually he meant to say the whole document is toilet paper now. A two term amendment on Presidents is the next one to go up in a blaze.

Nothing is twisted. Theres is now a full faith and credit clause argument to be made since the Supreme Courts ruling. Every federal judge that has heard these cases since the SC ruling has ruled the same way. It should be noted, the judge in Kentucky was appointed by George H.W. Bush on the recommendation of Republican Senator Mitch McConnell.

2 RINOs

Awesome

But you can not make an argument that the 14th amendment was meant to have this kind of influence and scope. Judicial activism at its finest

Basically the 14th amendment has been used time and time again to nullify the 10th amendment.

Why post that? Just because this issue is something I care about doesn't mean I am not concerned with the unsustainable spending that the federal government is doing.

bunch of lawyers in here today.

You can't treat a certain group of citizens differently without proving a substantial state interest being involved.

I wish we could just go ahead and pass the gay thing already. We have some more important things for our court system to be working on.

Why do we even waste our time to vote when the majority of people can be so easily overridden by one to nine judges?

Interesting because DOMA Section 2 was not found unconstitutional.

quote:

No State, territory, or possession of the United States, or Indian tribe, shall be required to give effect to any public act, record, or judicial proceeding of any other State, territory, possession, or tribe respecting a relationship between persons of the same sex that is treated as a marriage under the laws of such other State, territory, possession, or tribe, or a right or claim arising from such relationship.

That is still the law of the land and constitutional per the Supreme Court.

When did marriage become a right?

Edit: Let me preface that by saying I don't care if gays can get married. I do care that the Federal Government continues to overstep its authority by telling states which laws they have to enforce.
