UPDATE: Figured I would try to ask/tell her to give it back, and if that didn't work, just eat the loss as it wouldn't be worth the time. Well after a stern voicemail I left, she gave me an excuse why she hadn't sent it back, and a week later I finally got it in the mail.

Related I guess, in that it's tenant landlord and I don't want to start a new thread:

Getting the deposit back- landlord hasn't given me any money or an itemized list. Simply a top line number that he claims to have laid out and like 4-5 examples of repairs that even he referred to as normal wear and tear or preventative work.... One of the examples being a known and provable lie, and a couple that are made up but no idea how to prove.... Plus missed rent "while the work was done" which best I can tell was a fresh coat of paint after several years- I shouldn't be charged rent from the day I left til it was filled because he painted.... He's willing to call it even and just not give me any back even though by his calculations I'm in the hole. Nice guy.

At the end of thirty days wait after leaving I told him I didn't want to wait any longer for my list please send me my deposit in full, citing the basic la law. Got brushed off. Had an attorney send a demand letter to dot I's and cross t's and he refused to sign for it. Had attorney send a quick copy of a court filing (really seems willful refusal should make this EASY) and no reply. If I go ahead and file, will it be a slam dunk, or anything I should worry about/consider before laying out the cash?

The apartment and I are in New Orleans. He's out of state.
