What about the right to due and fair process as well as first amendment rights of the tea party people?

They are also entitled to due and fair process and equal treatment under the law.

Also, as she was not a defendant she can invoke the Fifth on selective questions.

Why dont you actually stick with a coherent fricking position? She was COMPELLED to appear unlike a criminal proceeding which allows her to refuse to do so.

Sheesh is DU full of sycophants as stupid as you or are they just having a bad week?

But not fair treatment by those that enforce the tax code right?

If a judge agrees with rex he will be on here gloating about how he was correct (even if the judge rules for very different reasons...like ACA). If the judge rules against rexie, he will be here telling us all the judge is wrong (like citizens united). Rex never loses an argument...just ask him.

Wrong again. I said from the very beginning that the ACA could be defended and found constitutional under Congress's authority to tax. And that's what happened.

f she's innocent why wouldn't she just answer the questions?

Hell if you aren't doing anything wrong, why do we even need the 4th amendment either?

With your reasoning, we could just dispense with the entire BofR.

Like I said...you are a legend in your own mind.

By far my favorite poster on here, though.

There are multiple reasons why the "Lerner waived her rights" angle is incorrect.
quote:

She was COMPELLED to appear unlike a criminal proceeding

And she can't be compelled to abandon her Fifth Amendment rights.

You must be calling for the repeal of the ACA since all tax legislation must originate in the House and the ACA originated in the Senate, which makes it unconstitutional.

You make no sense. Our tax code is part of our law. Equal treatment under our tax code was thereby implied in my response.

Uhh, I don't know how you arrived at that conclusion.

I'm not sure. At least the deciding vote.

The point is to stick with this instead of the bull shite about being a witness versus a defendant. She was not "allowed" to refuse to testify as in a criminal proceeding which should afford her more leeway now regarding selective invocation.

The problem with that is that Lerner did not open up any area of inquiry
Of course she did. She addressed her previous testimony before Congress.

Rex. I like you and have defended you on this board since the beginning. But this Bush v. Gore thing makes me think you have the herpes. You just can't get rid of it.
