Aurora shooting: police were warned that James Holmes posed danger

LINK

quote:

A psychiatrist who treated the suspect in last year's Aurora cinema shooting in Colorado told police a month before the attack that James Holmes had homicidal thoughts and was a danger to the public, newly released documents show. The attack killed 12 and injured 70 and was one of the worst mass shootings in US history.

The documents released on Thursday show Dr Lynne Fenton told police at the University of Colorado, Denver, that Holmes also threatened and intimidated her.

quote:

In the days after the shooting, campus police said they had never had contact with Holmes, a graduate student at the university. But campus police told investigators that Fenton had contacted them, following her legal requirement to report specific threats to authorities, according to a search warrant affidavit.

"Dr Fenton advised that through her contact with James Holmes she was reporting, per her requirement, his danger to the public due to homicidal statements he had made," the affidavit said.

So....there are laws in place to keep bad/sick people from hurting others, yet law enforcement did not enforce the law. We obviously need more gun laws.

Funny how this was withheld until after Colorado passed all their guns bills...

add to that the defense team is more concerned with how the journalists found out about the "notebook" rather than LE taking action against Holmes prior to the shooting.

He should have been admitted into a mental hospital by his Dr.

You can't be charged with thoughts, if so I would go to jail every rush hour. It said thoughts not conspiring right? On my phone.

"Dr Fenton advised that through her contact with James Holmes she was reporting, per her requirement, his danger to the public due to homicidal statements he had made," the affidavit said.

But LE could have gone to his residence and interviewed him about his statements.

Holmes bought his guns ~1-2 months prior to the attack. Depending on the exact dates LE was informed some of the gun sales could have been stopped by following existing laws...

Not defending either one bc I'm sure both have to battle red tape to keep from getting sued. I'm pretty sure she could have signed an order for le to pick him up and have him transported to a mental facility. Do you really want uneducated le interviewing someone about mental health?

I'm not a shrink or LE so I don't nuances of either parties responsibility. She stated, by requirement of law, she informed LE that Holmes was a threat to society. Can she have Holmes detained without help from LE or is up to LE to react to the information she provided?

I can only go by what I know about Louisiana. In Louisiana, he would have to be committed by a doctor then law enforcement could pick him up and bring him to a hospital. He cannot be arrested and be brought to jail.

Hmmm, so it seems like this should be the issue that we should be focused on...and not what type of guns he used

or is this too "common sense" for the "common sense" solutions?
