Three states will vote Nov. 6 on whether to allow recreational use of marijuana. There's still a federal prohibition, and approval would surely bring court challenges.

trying to regulate the sale will be their downfall as it opens the door for the feds to step in via the commerce clause. If they just de-criminalized use under state law, it would effectively legalize it...unless you ran into a federal marshal while smoking.

My only question is how will it be regulated? I doubt they're going to want people smoking in public/driving after smoking. Do they have a valid test to determine if someone is under influence or is it going to be up to police discretion? Seems like this has to be hammered out before they would be cool with widespread legal usage. Just my 2 cents.
