John Roberts, evil genius

First, remember that “Obamacare” and the individual mandate started out as a proposal from the conservative Heritage Foundation as a counterproposal to the Clinton administration’s health care plan. The only reasons Republicans are now opposed to it is because Obama proposed it and is getting credit for it. Before it was Obamacare, the program was known as Romneycare in Massachusetts — and if the 2008 election had gone the other way, it might be known as McCaincare today.

Meantime, the survival of the Affordable Care Act eliminates any clamor for real, progressive health care reform, whether universal Medicare or for the creation of a public insurance option. Such programs are anathema to conservatives who want most things privatized — either for ideological reasons or so that their corporate masters can further enrich themselves.

Wow. John Roberts issues a majority opinion where all the pundits don't know whether to shite or go blind. Evil genius or traitor to the party of the guy who nominated him, I'd imagine he's wiping away tears of mirth about all the hand wringing that's gone on today.

He probably thinks/thought this law has no chance of standing practically and politically and will eventually die or morph in to something better. This also gives him political cover for the cases coming down the pike (e.g., Catholic Bishops vs. HHS).

I also saw these points on another blog:

8) The next SC justice will be an ultra-conservative along likes of Clarence Thomas knowing you can’t chance a John Roberts.

I tend to think the weight of the win in the form of the Court's further reigning in the CC outweighs the weight of the loss in the form of the ACA being upheld.

Yep, this is what I have been believing all day since I got my temper under control and my cooler head prevailed.

He essentially punted today and it was a good punt.

In a very subtle manner, he gave the Romney campaign a huge lift in money, a fired up base and new talking points to hammer Barack Obama on that will ultimately doom his reelection chances all the while preserving the Court's integrity.

Chief Justice John Roberts just might have gotten Mitt Romney elected president.

I'd argue whichever side "lost" today would really be big winners in Novemeber.

This says it all from the OP....

You weren't alone. I was furious at first. Had to work my way through the opinion a few times to really see what he had done.

If you've really read the opinion, you can appreciate what he did. Sure, Republicans lost the policy battle over Obamacare but received a tremendous boost regarding limited government.

Yep, I sporadically took time out of my day to read through the opinion. It's like multiple small victories and one huge loss. But my bet is that the small victories turn out to be huge ones down the road.

Limited govt conservatives like you and I lost the battle today, but if the reaction today is any indication, we're sure as hell winning the war in November.

Since this is predominately a CFB board, I view the whole political struggle like the Bama-LSU game on 11/5, only the game will never end. It's like the first Ward-Gatti fight. You only lose if you stop fighting.

Don't get me wrong, I'm disappointed it wasn't struck down. I wish they would've just struck it down and dealt with the "political backlash" -- even though I think it's ridiculous that is a factor in these decisions, I know it is. So be it. It was just a battle, as you say.

But considering it wasn't, we got about the best result possible. People are rightfully concerned with the effect on taxation, but I see some major legal problems with their argument especially with how Roberts framed his argument and reasoning.

Thinking very long-term, big picture, this is a good thing for Republicans and conservatives. I know some won't be convinced of that, but I firmly believe it is. Hopefully, November just accelerates the process.

I really think Roberts is going to be one of the best Cheif Justices this country has ever seen. He was able to slit hairs and enhance the SCOTUS reputation. Brilliantly, Roberts has sent this back to the people for the last word. I think people should be applauding his decision.

I don't buy it. He caved for whatever reason, spin it how you will, give me someone who adheres to the constitution any day, even if they are a commoner, I'll take them over someone who has to show everyone else that he has the IQ of otto.

I agree. After hours of reading the decision and a variety of interpretations, I am now content with this decision.

Conservatives won the constitutional victory.

Liberals won the political victory.

One is like rock while the other mere dust in the wind (in the grand scheme of things).
