If your buddy came away feeling “sunshine and rosy” about the meeting/conversation I am sure the agent sensed that, wrote some ticket to re-establish his authority and drove away thinking it just got that much easier to have his way out there. Seems to me you either act now or subject yourself to the torture of hoping that it’s over. You’ll go mad every time you drive out there wondering what’s next. IMO. Shitty deal all around hope it works out for you and your friend.

Thanks man.

So just to recap...there should be no reason he can legally take my card correct? I know WLF have some leeway with entering property and things like that but he shouldn't be able take my card for ANY reason, correct?

I wonder if they are able to look at the card if they have a card reader and let's just say he accidentally put the wrong card back being they were identical...

Maybe if he feels that you did something illegal and it is on camera (not saying you did anything wrong). That is the only POSSIBLE reason I could think that would allow him to take your card.

Thinking about this in terms of a normal camera/computer and cops, I don’t think they can confiscate a camera/computer just for shits and giggles. If they thought there was something incriminating or pertinent to a case they would have to get some sort of warrant wouldn’t they? I know on real TV (not CSI etc) when they bust computer hackers etc. they have to have a warrant before they can search and seize computers. Can’t see why a harmless game cam would be any different. I may be way off, but that makes enough sense to me.

ETA - Differentiate between real tv and dramas

Under the circumstances it was taken, I would say absolutely not. He basically stole your property. They can only seize property that is used in the commission of a crime.. i.e. you gun if you're spotlighting, your truck if you're spotlighting. Taking a camera, mounted on a tree, on your property, does not give him any right at all to take or your feeder, if he's responsible for that also.

See I don't think he had a card reader with him. I think he took the whole camera and brought it back with the wrong card. In my first threa I said how when I went to check the camer it was on a different tree and strapped up a different way. With my cameras you don't need to take them down to get the card out and if he had taken it down, checked it, and put it back up, it should have been easy to put it on the right tree. The tree he put it on was too far away from the other for him to forget that quickly.

If you think it out, he was up to something. He would have to have some justification to seize a card. Maybe probable cause, I don't know. Why not impound the whole camera if he thought you were doing something or it contained “evidence”. Then he puts a personal card in, not a department issued replacement card (if there is such a thing), and leaves no documentation that he did this. He was up to something, you caught him. What he was doing, no telling. You have a dilemma on your hands as what to do. I would get some professional advice, retired agent, law enforcement or something.

I agree with this. He has to be. There is no reason to take your camera without notifying you and then replacing it unless he is doing something shady.

This is what I would do. He/ she should be able to tell you if this is legal or if something is wrong.

The only reason I would take a sd card from someones camera is if I was knowingly tresspassing and thought I got caught on camera. I have been on other peoples property and found the camera before it found me.

If he was on your property in a non-official role (ie, poaching) he may have had what he thought was an empty with him and switched them on the spot.

If I am going to poach somewhere (which I don't do) I wouldn't need to look at your pictures. I would know that there are big bucks there and go after one.

Either A the camera took a picture of him and he didnt want you to know.

Or B he was scouting your property.

If he had a camera with him, he could have taken out your card, put it in his camera, deleted picture that was taken of him, got mixed up and put the wrong card back into your camera.

Regardless on private land it would seem to be an illegal search. his story would probably be A and he was in the discharge of his duties and made a mistake.

My theory:

He was trespassing in an unofficial manner. He stumbled upon the camera. Decided to take it/the card to see what kind of deer are around for future poaching possibilities. Replaced it with the wrong card. Now caught again, realized the friend was nervous and took control, writing a ticket, thus establishing himself as being in the right by being on the property. Will do away with the ticket, to appear as doing a favor and hoping that nothing else is said, while continuing to trespass and hunt while rightful folks are away.

I don't know if I would call him (the agent) out on it in the woods by myself with him and another agent. They might shoot you down and then claim self defense.

He probably got caught on the camera before he noticed it like someone else said. He then switched the card thinking it was blank. Can you tell if there was down time on the camera? Meaning did he switch them immediatly, or bring it home first and then replace it? The former would lead you to believe he is alreading poaching on your land and was caught on camera. Send him some pics in the mail from the card
