On a guided hunt last May, two bears — a male and a female — came into view. Investigators said she shot the male and attempted to kill it with a second shot, but instead killed the second bear. Both bears died.....Theresa Vail was sentenced in state court Wednesday to one year of probation and a $750 fine. The sentence also included $1,300 restitution

I wonder if she'd have been charged if, instead of misidentifying the wounded bear, she had stumbled and "accidentally" shot her guide. I think there's a double standard in regards to accidentally killing an animal versus another hunter.

Had she reported it then and there, she probably would of been okay, however she choose to have an additional tag flown in the next day and backdated and signed it, (at the guides request) ,doing all that I am surprised she got off with such a light sentence

Different situation, you mistake a black bear for a hog.

Early foggy September morning four small ducks buzz your set up and you kill one only to realize it was a wood duck.

You get fined in these situations but mistake a hunter for a deer it's a tragic accident.

I see what you are saying and I agree, you shoot Another hunter,(or your own son) it should be murder and not a tragic accident

She shot another bear not a person. She knew what her target was.

Yep. She gets a pass. I would call her to my chambers for community service.

People who shoot other hunters should be judged more harshly than they are. If a hunter legitimately shoots at an identified animal, but there is an unseen human behind the target or somehow in the line of fire, that Is a tragic accident, unless the shooter did not make a reasonable effort to know about the other hunter.

On the other hand, if the shooter is shooting at sound or movement and has not identified his target properly and hits what he is aiming at, which happens to be a human, that should be negligent homicide, a crime.

Boo this man. She thought she was making a follow up shot and instead stuck two. Trying to cover it up lions bad but who doesn't say "Oh shite. Can I fix this?" I can't, and won't hold her in the same light as another illegal hunter like a spotlighter

This is my opinion, I don't advocate punishing a man who makes a tragic mistake and kills his son and I think some one accidentally killing an animal should get clemency.

There is a lack of "criminal intent" here.

Easy solution to all this. Add humans to prohibited species list in the fish and game chapters.
