You know I keep seeing these cases, and other similar ones, being referenced when this subject comes up. I don't necessarily disagree with any of it, I just feel that's a wasted effort. It seems like it only accomplishes a discussion in semantics.
I would rather see a stance taken that draws on emotions and philosophy. William Forster Lloyd wrote the Tragedy of the Commons and it's an excellent essay that pertains to our situation but I never see it brought up when discussion the marsh. It's possible for everyone to exist side by side. Read Elinor Ostrom, get an understanding for what it means to coexist.
You guys at LASC can win, but I'm skeptical if you can win by demanding unregulated and unabated access to all tidal waterways.

You mentioned earlier there will have to be some give and take, or a middle ground if you will, that is exactly the path we intend to take. There will have to be some a firm stance at times, but going in demanding things may not be the best negotiating tactic in this instance.

I am going to steal an idea from a close friend and share it.. Don't even bother with public meetings rightnow. Start an add campaign. Save that tshirt and sticker money and advertise that 80%-ish of all the marsh is inaccessible to the people who are funding it's protection. Use sportsmens paradise against itself. Point out the absurdity of the 1812 maps. Hammer the point home that access is good and by protecting our access we are preserving our history.

I don't mind a busy launch. But the dude that sat in line for 15 minutes in his truck then proceeded to prep the boat AFTER back down the ramp... he makes me blow a gasket

So in this instance any land that was lost due to erosion since 1812 is now going to be public?
The landowner will stop paying taxes on that land?
And if the land somehow builds back up the landowner no longer owns it?

It's not in fact land anymore stop calling it that. Public in the sense of navigable access if recreational purposes ONLY.

Then you will loose the mineral rights and the rights to build structures, likely to be swooped up by another citizen who paid the back taxes to the parish and sees the advantage of holding the rights the previous owner gave up.

I believe it would be Marxism. He wrote in 1848 about the abolishment of all private property. This is obviously not something I am in favor.
What are your feelings on the 14th amendment and how it pertains to eminent domain. What about the Midnight Forest in March of 1907?
