Well assuming your neighbor has an issue with it Id hope he would contact you and yall could sort it out before getting the law involved. If it was a stalemate between you and your neighbor then technically the law would be on his side.

I think the key is don't be a dick. Put up a stand. As long as you are not on top of the neighbors stand you should be fine. Remember that property lines have two sides.
I would never setup on top of a neighbor.
Get to know your neighbors. This is a big key. Knowing your neighbor will go a long way in many situations.
