Two Bridge City brothers who pleaded guilty to a federal wildlife violation in connection with the death of a bottlenose dolphin in Cow Bayou last year were sentenced to one year of probation, including a ban on hunting and fishing, and will share $7,353.50 in restitution.

U.S. Magistrate Keith Giblin sentenced Cory James Moseley, 23, and Cade Ryan Moseley, 18, during a brief hearing Wednesday morning. The Moseleys did not address the court in detail.

quote:

The brothers were fishing on Cow Bayou near Orangefield on July 26, 2014 when they spotted a pair of dolphins.

Cory Moseley allegedly shot at the dolphins multiple times with a compound bow. He did not strike either dolphin, according to information presented to the court.

Younger brother Cade Moselely was accused of firing the arrow that the U.S. government said claimed the dolphin's life.

David Barlow, the attorney who represented Cade Moseley, said the "avid outdoorsmen" did not know shooting at a dolphin was a federal crime and called it a "dumb, youthful" act.

The juvenile dolphin did not die immediately, but swam away and suffered a "painful death," Giblin said, reading material that the National Oceanic and Atmospheric Administration submitted to the court. NOAA also told the court the accusations represent the "most extreme circumstances the (taking a marine mammal) statute entails," Giblin said.

The second dolphin was found in the bayou and rescued by wildlife agents and SeaWorld San Antonio personnel.

Although I'm an avid outdoorsman and don't EVER kill anything without a reason, I don't think there is any shortage of dolphins.

Those bastards took 4 trout off our lines yesterday. There's no way in hell those things are in any way endangered. That being said, I don't advocate killing dolphins. Just a little whack with a paddle I'd be ok with though.

Should've gotten a 5 year ban on hunting and fishing. Also, how does the court figure out that a dolphin is worth $7353.50?

Both of them should have gotten jail time. No different than poaching deer or any other game. I would have thought Texas would have been a little more hardass about stuff like this.

Hard to tell on my phone, but that looks to be at least two ducks over the daily bag limit for ole Cory. Avid sportsman, indeed.

ETA: maybe as many as four, now that I look at it, not counting the goose.

What happened to "ignorance of the law is no excuse?"

This.

I wonder if they will abide by the terms of their probation to not hunt or fish for a year?

And they never have been. All marine mammals are protected and fall under the jurisdiction of the feds as part of the Marine Mammal Protection Act.

The government has set prices on what an animal is worth. Like in LA a duck is roughly worth $26 a doe is 1k a "trophy" buck is 2500 etc. I'll see if I can find my restitution list if you're really that interested.

I would be, they are pretty damn specific, they charge for dolphins on 50 cent increments.

I can definitely see 11 ducks, so I bet there is one more to make 12 in there somewhere....not really a big deal, just posing with a community stringer. No face paint and no knee boots
