The St. Bernard Sheriff’s Office arrested a Chalmette man on various narcotics and weapons charges following an investigation by the Special Investigations Division Narcotics Unit, Sheriff James Pohlmann said.

How it started:

quote:

Special Investigations Division Narcotics Unit agents who were making proactive patrols in the Arabi area conducted a traffic stop for front windshield tint on a white Nissan traveling westbound on West Judge Perez Drive near Alexander Avenue.

Windshield tint. They pulled him over for windshield tint.

How it went:

quote:

During the traffic stop, agents detected a strong odor of marijuana emitting from the interior of the vehicle which was driven by Silvan.
Following a search of the vehicle, agents recovered a clear plastic bag containing 59 grams of marijuana with an approximate street value of $1,180, 10 Tramadol tablets, and a digital scale.
Agents also recovered from Silvan's possession a Glock 17 .9 mm semi-automatic handgun with a switch that is used to turn it into a fully automatic weapon, as well as an extended magazine. The gun also was discovered to be listed as stolen out of Calcasieu Parish.

How it ended:

quote:

Based on these findings, agents opened an investigation which led to obtaining a search warrant for Silvan’s residence.
During the course of the investigation, agents recovered from Silvan’s residence several clear plastic bags containing a total of 33 grams of cocaine and fentanyl with an approximate street value of $3,300; a clear plastic bag containing 30 grams of heroin and fentanyl with an approximate street value of $3,000; several plastic bags containing a total of 362 grams of marijuana with an approximate street value of $6,920; methamphetamine, Oxycodone, clear plastic bags, and a digital scale.
A criminal history check was conducted on Silvan which revealed he is a convicted felon and did not have a valid driver’s license.
Based on these findings, Silvan was transported to St. Bernard Parish Prison to be booked on the above charges. His bond has been set at $493,350.

So this dude was a convicted felon with a stolen altered gun, who had a small pharmacy of illegal drugs... busted... not because of some great federal task force investigation or someone turning a snitch... but because an officer saw illegal window tint.

a. This isn't really an example of Broken Windows policing

b. If you're willing to give up your rights, cool. Some people value them more highly than you do.

I think most peoples issue is being given a fix it ticket for window tint when you’re otherwise a well adjusted law abiding citizen.

I get what you’re saying but this is windshield tint not window tint. That has never been legal.

I’ve always wondered though, how can states with varying tint laws ticket vehicles that are just visiting or passing through? I’m surprised there’s never been a big court case about this.

You're subject to the laws of the jurisdiction which you are in, no different than if visiting a other country.

I get what you’re saying, but it’s a state, nor a country. This would be like arresting someone in California for driving from Arizona to Washington with an AR15 in the trunk, unloaded (legal to do this under federal law).

The vehicle must meet the laws for which it is licensed. Alabama allows tint to up 95% on all windows (except windshield), so vehicles tagged in Alabama driving in LA should not be cited.

The rule was 2 of 3 must match; DL, Tags, address of residence.

How about just keep criminals in jail?

I would be interested to know the details of his prior arrest(s) and conviction(s) and parole(s).

He likely should never have been on the streets to begin with.

That officer used the excuse of the window tint. They knew more than that. About 1% of police will stop someone for window tint only.

If it's one thing I've learned by watching decades of episodes of "Cops," it's that if I ever find myself cruising around with illegal narcotics in my car, I'm going to make damn sure all of my lights are working, my insurance/registration/license is up to date, I'm not transporting said narcotics through the hood at 2am, the inspection sticker is current, I'm driving the speed limit, and I'm coming to a complete stop at all stop signs.
