Why is it called date rape? Shouldn't it be just rape?

Here is the thing that is tricky, if a girl is wasted and forgets everything, she could claim that she was too drunk to consent. Guys now a days should not sleep with drunk girls for fear of getting accused of rape.
The statutes of limitations in most states is 7 years. There are tons of people who probably slept with someone too drunk to consent in the last 7 years and didn't realize it at the time. If the victims wanted to they could file a suit at any time within those 7 years.
If two drunk people bang but the girl wakes up and doesn't remember giving consent then she may have a case for rape. The sad thing is that the guy may not remember either but his chances of a counter rape suit are skim.

As long as you don't go way over your head and frick somebody who is too good for you (2 or more out of 10 on the scale) and as long as you text her the next morning and make plans to hang out again you won't be accused of rape.
