Townhouse parking lot gate closed on my tenant’s vehicle - potentially threatening lawsuit

Who’s at fault here? He said the sensors on the outside of the gate to prevent this from happening malfunctioned. Tenant is threatening to sue me for left side damage to his vehicle.
If he does, indeed, decides to sue me, could I have a case against the HOA or the gate company?
Oh, the spoils of being a landlord...

Do you own the gate or is it pooled ownership?

His case is against the hoa and when he talks to a lawyer they’ll tell him that.

And here you admit that the gate did indeed cause damage to his vehicle
So why don't you avoid the lawsuit and pay for his vehicle damage

You don’t own the gate. Sounds like that’s who he’s looking for, so I’d point him in the right direction and let him go.

ive Never seen a trailer park with a gate before

It’s going to cost him more to pay an attorney than to fix his car
Call his bluff and say go ahead

Is martini banned?
I know it has nothing to do with your problem, just a general question

Just tell the tenant that you’ve requested legal advice from the OT. Tenant will know that means they have no hope of winning and drop the suit.

Depends... Any chance it's a gate that allows only 1 vehicle at a time and he followed someone else in? Is their sign posted with instructions? If HOA ownes the gate it should be their problem.
