OT lawyers, I need your help

Ok so one week of work I worked 60 hours. So I look at my paycheck and it says 50 hours worked. So I called them and asked what the deal was. They said we've hired a new girl for payroll and she hasn't gotten down how to do everything yet. We will put it on the next check. Well next check comes and it's still missing. Same story from them. This has been going on a month now. Do I have any legal action?

Yes you have a legal action if they’re withholding ten hours of pay.

Yes they are withholding 10 hours of overtime pay, that I legally worked. What kind of legal action do I take here.

Is anyone going to mention how suing your employer generally leads to being fired? Enjoy that ten hours of OT when they tell you it is your severance and to GTFO. Is this McDonalds or someplace where you can get the same job down the street?

write a letter to payroll, copy ceo of your company. Request a special check within 5 days. State all facts

How big is the company?

Same. Just switched over to salaried and I hope to never go back to hourly.

Saw it happen to a couple of friends of mine last year, though. They had to route their complaint all the way up to the national corporate office before it was rectified.

Taking legal action probably isn't wise, though, OP. More of an HR issue. If they bungle it after given ample opportunity to fix it, then you can start thinking legal.

I’d take some steps between making a couple of phone calls spread over a month and taking legal action against your employer over 10 hours, but that’s just me.

I would assume that from an accounting perspective, it’s causing an issue, because you don’t have a time sheet backing up that extra 10 hours for the pay period of the check.

I'd send a pretty strongly worded email that you need your check by the end of the week first. If you still don't have it tell them you are going to being legal action against them. If it comes to that hope they fire you as you'll get paid bigly for retaliation against an employee. Either way this is bullshite and I would be looking for another job of you can.
