She's actually right. She's isn't detained by a violation of law so she could get out and walk to "that house".

So there is a code or law or whatever that someone can claim "free inhabitant" not have to show identification and it states that the laws of the United States do not have to be abided by?

Serious question. With the way things are today I truly wouldn't be shocked.

What she is claiming re: freeman is bullshite. That's not the debate. As the passenger, and having not committed a crime, she can't be detained or identified simply because they ask. She can decline. She can be free to go. She's an idiot but she's a free to go idiot.

But she was in a vehicle that was stopped for a violation right? If she fails to corporate it is within the law to arrest her.. I think

No. His warrant, violation or suspended license (whatever it is) can't be transferred to her. Had she been smart she simply sits there and waits it out or start walking.

No idea but by listening it's likely a registration, license or warrant ordeal. He admits he doesn't think she's done anything wrong which eliminates drugs, DUI etc. Not saying she's not a dipshit but she has every right to walk away without detention. We all do when a cop can't articulate a crime on us. Please use it if you're ever in a situation like this. Don't let them arrest you without cause. And record. Tom Zebra thanks you.

Wrong. That used to be the law but SCOTUS made a decision in the last couple of years that passengers can be detained and identified. I can't remember the citation right this second and really don't want to look it up. Google away though. Prior to that, the police had zero authority to order a passenger from the car or detain them if they tried to leave.

FWIW, I am a pretty staunch law and order guy but think this decision is an amazing overreach along the lines of the DWI checkpoint decision. Never the less, they likened it to the police coming upon a crime scene and having the authority to perform an investigative detention to identify who is and isn't involved in the crime.
