This is a huge mess. It wrecked our fence and will cost thousands to remove.

I'm adding a picture to prove I'm not lying. Y'all have some trust issues.

Stop saying I'm trashy because I have a window unit on a SHED that is detached from my home. Geez.

The people saying that their insurance covers everything have no idea. It's not clear who is going to pay yet and debris removal limits to $500. This will be about $3000, just for the removal. The costs of damages to the fence and our son's play set aren't the major expense.

Most importantly, my son wasn't on the play set when this happened.

Update: Yes she knew it was a risk and fully admits it. I'm not angry because we loved that tree too. We are going to work together to reduce both our costs. I got that quote a few hours after it happened but we all know it was probably inflated because my husband wasn't home. We both have people who want to help and want the firewood. It's not as big of a mess as I thought initially. We have a good relationship with this neighbor and it will stay that way.

Oh and frick all the posters that assumed I was a trashy litigious bitch and thanks to those that gave me real advice.

Post crash

Pre-crash pic for those saying this was not a live oak

Her backyard has no damage other than enormous trunk and our shared fence.

Her tree snapped from rot.

Our new view- and yes my son loves it.

Homeowners insurance, either theirs or yours. Probably theirs.

Why the frick do you care how much your neighbor or their insurance will have to pay? You'll probably get newer and better shite. You should be glad. It will look better when summer is here

salvage the limbs and sell them to the pirates down by the docks to make their ships.

Thanks a-holes. When shite happens there is nothing like a good roast to snap out of self pity, and I can always count on the OT.

Your neighbor’s tree falls on your fence. It doesn’t matter who owns the tree, says the Insurance Information Institute: If it lands on your fence, you file the claim with your own insurance company. However, if there’s evidence that the tree was weakened because your neighbor overlooked basic maintenance or ignored disease, your insurance company may try to recover its costs from your neighbor’s insurance company (which may also earn you back the deductible you paid when you filed your claim).

sounds like you'll likely be out ur deductible

Since it's on the neighbor's land, they're responsible to help pay for the damage to your property.

what were you seriously expecting?

at the very least it should cost whatever your deductible is.

but most likely neighbors insurance is on the hook.

call your insurance agent.

at least nobody was hurt. things could be much worse.
