A federal jury on Thursday ruled that Oregon State Police Capt. Rob Edwards violated a Eugene man’s civil rights by kicking him in the upper chest after chasing down his speeding motor­cycle on Crow Road.

The eight-member jury heard evidence in a trial in U.S. District Court in Eugene earlier this week, and spent about four hours Thursday deliberating before returning a verdict that supports Justin Wilkens’ excessive-force claim in regard to the kick.

Wilkens was awarded more than $180,000 in total damages.

Jurors additionally determined that Edwards acted with negligence when his police car rear-ended Wilkens’ motorcycle, but ruled that the veteran state trooper did not violate Wilkens’ rights by pointing a gun at him and using force to handcuff and then pull Wilkens to his feet. Wilkens suffered a broken left clavicle, a fractured rib and other injuries in the Aug. 3, 2012, incident.

“I’m just happy as heck,” Wilkens, 41, said as he left the courthouse

This is crazy.

Fleeing to elude is a felony. Not to mention the multiple offenses he committed along the way.

If the cop had shot him dead, then that would have been excessive. But knocking him off his bike and subduing him was the proper police action.

Hats off to the officer in question and boo to the Oregon justice system for a bad call.

I would bet this isn't this guys first run in with the law. Probably one of the trouble makers who the cops have to deal with a few times a month.

Did you read the full story? Officer was in an unmarked black Camarro. The guy bike stopped and complied when he saw the flashers in the grill of the car.

Should have been a speeding ticket, not an assault.

Dude, as a motorcyclist myself you're going to notice a car tailing your arse at 100mph when you pass cars on the double yellow. Bike mirrors aren't the best but you damn sure see red and blue lights when the car is 100 feet behind you.

So the dude admits he expected a ticket when he pulled over so he must have seen something?

This is bullshite pure and simple.

Looks to me like he didn't see the unmarked cop car until he got to the light.

And I call bull shite on any biker saying he looks in his rear view mirrors when taking curves at 100+ mph, your eyes are ahead of you and no where else unless you are wanting to die.

You're retarded. A simple mirror check on the straights will reveal the cruiser bearing down on you. The cop rode up on his arse several times before he was able to safely make a pass on the cars in his lane.

This is a classic case of "playing dumb" and some POS lawyer takes advantage of it.

Regardless, stopping the illegal reckless driving when he came to a stop was the cops job. Should cops just drive behind perps and assume they are "unaware" indefinitely?
