Yes. I think that is where everyone is getting confused. If you have already started your turn then someone tries to pass and slams into the side of your vehicle. The passing vehicle would be at fault.

If someone is passing you and you turn into the side of the passing vehicle then the turning vehicle is at fault.

Just talked to my brother who works in insurance.

Basically stated that it really depends on the impact area.

If the impatient driver hits the car turning in the rear, then the Impatient Driver is at fault.

If the point of impact is in the front or middle of the car, then the fault is on the person turning.

When I took a sports law class, don't know why but this excat question was given to us.

Both are at fault

The whole thing hinges on the turn into a private driveway, as was originally posted. If the left turn is into a private driveway, vehicle A has to yield. Not so if the left turn is into another roadway.

Driver A. Louisiana law views left turns as the inherently dangerous maneuver. The other car has the legal right to pass, and therefore driver A is at fault. It seems strange, but I've seen cases of this.

Yes and also a divided highway in a legal passing zone. This topic came up in my court ordered defensive driving course.

I don't see how people can't see how A is in the wrong. They operated their vehicle into the path of another legally operated vehicle.
