Is it time to evict my tenant?

Have a tenant who has rented from us for 5 years. When she begin renting she was and still is a single mom, her daughter did have some special medical needs, due to this My wife and I have always tried to work with her on monthly rental payments. We allow her to pay 1/2 on the first and the other 1/2 on the 15th. Based on her pay periods!
Over there years there have been times where she would tell us she couldn't pay on time, we have always given her the option to put in writing how she would get caught up on rent. However the past 5 months have finally put me to my breaking point! She fail behind again a month and a 1/2 to be exact. She has been working to get caught up she had a payment due on Friday. She was to drop off we have not heard from her this is not the first this has happened. FYI we have not increased rent in 5 years

Would you guys evict a single mom and her 16 year old daughter knowing they would possibly be homeless? There just comes a point where you have to be accountable

Tough call to evict. In the end this is business but if you're not hurting for the money being a "good guy" has it's rewards.

FWIW I rent a house and they are "late" sometimes too.

Does she smoke? If she smokes I would. If you can afford to buy cigarettes, you can afford to pay your rent!

If it were me I would sit her down and let her know how close she is to getting evicted, come up with a plan to get caught up that makes sense, and give her one more chance.

depends on how cold-hearted a bastard you are. If you are Kevin O'leary-like about business, you kick her to the curb. If more philanthropic, demand payment, give here an arse chewing and one final chance to get right.

Do you need the rental $$ to stay afloat yourself?

If not, let her catch up, but have a sit down with her and explain your expectations moving forward.

Maybe give a firm written warning and if it happens again pull the trigger and boot her out.

If she doesn't get the hint after a written warning, she never will.

I don't think I could make myself do it, but that's why I would try really hard not to rent to someone like this because I know I wouldn't have the stones to kick someone out on the street.

"You have until year end to get caught up on rent. From 2017 forward, rent is due in full by the 5th of the month. If these terms are not met, you will be evicted. Thank you."

As always, please consult your attorney before making any rental modifications.

I would of never let her continue her lease. How long do you have left on the current lease? Yes, get her to leave. You can evict her to where she has time to move out and find a new place, there is plenty of middle ground here.

Not to be the a-hole of this thread, but the reason she's late and not paying is bc she knows she can be. If you start off a landlord relationship with these kind of special conditions then you can't really be surprised when she tries to take advantage of the situation

If you are not a hard arse, don't be a landlord. They will take advantage of you forever. I know from experience, hence, I am no longer a landlord.

If she's not wrecking the house I would try to give her as much slack as I could afford. If you can find a tenant that is going to rent for 5 years and then some and takes care of the place then renters like that are hard to find.

She's probably just embarrassed and at her wits end on how she's going to get out of this hole and doesn't know what to say.

If you could afford it maybe just have her pick up payments on the 1st & 15th like she was doing and pay however much she can on those normal dates or even carry it over until she gets her tax refund after the first.

Sounds like you have been very understanding with her though and don't get yourself jammed up if you need the money. But if the property is going to be empty for a cpl months then you're not going to be getting rent anyway, and the next person who rents it might not take as good care as she has.

Anyway, as I said, ut sounds like you've been patient and if you've had enough, then evict her, but I wouldn't just do it over a few hundred bucks. Leave a message telling her you're willing to work with her if she will just stay in touch. I've had people owe me money all the time and as long as they answer the phone and stay in touch and pay as they can I try to work with them, unless I find out they're out blowing money on bullshite and just avoiding trying to take advantage.

People have hard times. But, you're also not running a shelter either.
