HOA violation question - illegal sublet nearby

So we live in a quiet neighborhood that clearly prohibits sublets in the bylaws. The lady across the road (widow, 70ish) is now subletting to 2-3 guys that are rumored to be illegal immigrants. The HOA leader who is usually fire and brimstone on this stuff has some health issues and is backing off. It does not appear the lady has money issues and her family lives nearby.

What's your go-to here? I don't want to spend a ton of money on lawyers but we have no idea who these guys are and there has been no background checks of the type a mortgage or apartment owner would do.

Although some HOAs may have rules against subletting, the state/county/city may have laws that clash with the HOA's ability to prevent renters. A real estate attorney will likely be the best place to start.

I don't know if you've heard. It's legal to have slaves again and you can even claim them on taxes. Probably only as long as they are of the migrant class.

Don't think your little HOA will be able to stand up to daddy government.

Just buy a knockoff ICE shirt off Amazon for like $10 and start wearing it non-stop when you're outside.

Based on the reaction of the tenants...you'll have your answer.

Most HOA's allow at least one person not related by blood or marriage to live in the home. If you open that can of Karen make sure to apply it equally throughout the neighborhood.

Unless the HOA rule is very clearly written and applies to a specific situation, stopping someone from renting their house won't stand up in court.

Is she doing a sublet, or just renting directly? An owner can prohibit sublets in a rental agreement, but you really can't prohibit a homeowner from renting (not short term/airbnb) their house.

Call the police on them. Demand the HOA do something or stop paying dues.

Do you know anything about these renters? Do they have a criminal history? Are they pedophiles?

I would think the rest of the neighborhood would want to know if potential predators are subletting a house and not subject to the same HOA standards everyone else is.

He knows nothing about them but assumes they are illegal and unchecked by the lady
