My kid failed kindergarten. They hold kids back, usually the younger ones, when the are a little behind. My daughters birthday is a week before the cut off day. We decided to hold her back an d go to T-1. It is a transition to 1st grade. Las t April the light build went off in my daughter. The things she was struggling with all of a sudden became easy for her. I think it's more of a maturity issue with the kids that are held back not a kid failing kindergarten.

Does he have a learning disability that causes him to act out? Best have him checked. A friends son was always in trouble for not paying attention, always day dreaming and always getting punished. Turns out he was having petit mal seizures.
