1. If the temp for your water heater is abnormally hot and is indeed not switching back to pilot after it reaches the selected temp then the thermostat needs replacing asap.

2. If your tank is emptied of hot water and has to reheat a full tank you can expect 45-60 minutes to completely re heat it. So what you can do is turn the water inlet valve on the heater off then check the gas burner again in 45 minutes.
At that point the burner should be back to pilot.

My hot water heater seems like it has a constant flame (not the pilot light).

does it do the same thing during the summer when the attic is hot as hell?...

regaurdless, if it is in the attic, I agree with the suggestion that you need an insulating blanket...just be sure you don't block the air intake port or the area around the vent pipe....

also, you might want to insulate the inlet and outlet water pipes, as that is a major source of heat loss...

be sure the thermostat is set at a reasonable temp...

lastly, the thing may not be burning effeciently enough to heat the water in a reasonable time, so be sure the air/fuel mixture is correct...the flame should be blue, but not excessively noisy when burning...

ETA: you may want to fix your title to keep the thread from getting anchored...the subject is "water heater help" and not "your stupidity"....

Try turning the thermastat down to see if the flame will go out when lowered. If not, The thermostat maybe broken. If the flame goes out when you turn the thermostat down, it may just be a result of the extra cold weather and your higher water temperature setting.

By the way, to those who have a problem with saying hot water heater, you can go freak yourself. It's just a colloquialism. You say potato I say Patata. Besides the water in the tank pretty much remains hot all the time. it comes on to keep it hot. Therefore, it is a hot water heater.
